Today is day 2 of Tara McGovern’s trial. There were so many people present yesterday for day 1 in support of the JoCo7 that the proceedings had to be moved to a larger courtroom.

At the end of the first day of trial, McGovern’s defense attorney Gina Messamer moved again for the case to be dismissed based on a lack of evidence on the part of prosecution.
A motion of this nature is commonly tried by the defense but it is rarely entertained by the judge. In this case, Judge Burns made it clear that he felt that the evidence was paltry enough that the prosecution was given the evening of trial day 1 to try to come up with a more robust prosecution or else the judge will consider dropping one of more charges before the jury resumes at 9 am on day 2.
